Abstract:
Europejski Bank Centralny charakteryzuje się zasadą niezależność, która prezentowana jest
w literaturze przedmiotu w czterech aspektach: finansowym, instytucjonalnym, personalnym i funkcjonalnym. Wszystkie cztery zasady stanowią łącznie jedną zasadę niezależności, którą charakteryzuje się większość współczesnych banków centralnych i która decyduje o sukcesie wypełnianego przez bank mandatu. W opracowaniu przedstawiono aspekty prawne zasad niezależności EBC oraz niezależność unijnego „władcy monetarnego”, podczas globalnego kryzysu finansowego.

The functioning of the European Central Bank is governed by the principle of independence,
which is discussed in the literature in four aspects: financial, institutional, personal and functional. Nonetheless, all the mentioned facets constitute a total of one overall principle of independence, which is characteristic of most modern central banks and which determines the successful performance of their functions. The paper discusses the legal aspects of the principles of independence of the ECB and of the sovereign monetary authority exercised during the global financial crisis.
