Abstract:
Ustawa z 7 lipca 1994 r. - Prawo budowlane stanowi podstawę prawną urzeczywistnienia
zamierzenia budowlanego. W celu rozpoczęcia realizacji inwestycji na danym gruncie, w myśl wskazanej noweli, niezbędne jest uzyskanie pozwolenia na budowę. Niniejszy artykuł traktuje o istocie pozwolenia na budowę, wskazując na jego kluczową funkcję w procesie budowlanym. Ponadto poddaje pod rozwagę zasadność istnienia tej instytucji, która spotyka się z nieustanną krytyką środowisk związanych z wykonawstwem budowlanym. Podnoszonymi postulatami w przedmiotowym aspekcie są, m. in.: zniesienie obowiązku uzyskania pozwolenia na budowę i zgłoszenia budowy oraz zastąpienie ich uproszczoną procedurą wpisu do rejestru robót budowlanych, zniesienie instytucji zatwierdzenia projektu w drodze decyzji administracyjnej oraz zniesienie konieczności uzyskiwania pozwolenia na użytkowanie. Omawiany problem stanowi jeden z aspektów prac Komisji Kodyfikacyjnej Prawa Budowlanego, powołanej rozporządzeniem Rady Ministrów z 10 lipca 2012 r. celem opracowania tzw. kodeksu budowlanego, który ma nosić nazwę - Kodeks urbanistyczno- budowlany. Zakończenie prac zaplanowano na koniec listopada 2014 r., wówczas do systemu aktów prawnych wprowadzone mają zostać regulacje, których celem będzie usprawnienie procesu inwestycyjnego.

The Act of 7 July 1994 on the Construction Law provides the legal basis for the realization of
construction intents. According to this Act, in order to start the investment on the given premises it is necessary to obtain a building permit. This article deals with the nature of the building permit, pointing at its key role in the construction process. In addition, it discusses the justifiability of this requirement, since it is constantly receiving the ceaseless criticism on the part of the circles related to construction executives. The amendment proposals in this respect include: 1) elimination of the requirement to obtain the building permit and to notify the construction, which should be replaced by the simplified procedure consisting in an entry in the register of the construction works; 2) abolition of the institution of the approval of the project by means of the administrative decision; 3) abolition of the obligation of obtaining the permission for the usufruct. The discussed matters have become the center of the interest of the Commission for the Codification of Construction Law (Komisja Kodyfikacyjna Prawa
Budowlanego), which was created by virtue of the Regulation of the Council of Ministers of 10 July 2012 with a view to draw up the so-called building code, named: the Code of Urban Construction. The completion of work of the Commission is scheduled for the end of the November 2014; by this time the system of regulations created to streamline the investment process should have been finished.
