Abstract:
Autor podejmuje próbę oceny rozwiązań prawnych w ustawie z dnia 25 czerwca
2015 r. o zmianie ustawy – Kodeks pracy oraz niektórych innych ustaw. Zdaniem autora
analiza prowadzi do wniosku, iż wprowadzone ustawą nowelizującą regulacje nie opierają się na spójnych założeniach ogólnych, uwzględniających funkcje terminowych umów o
pracę – zwłaszcza na czas określony. Z drugiej jednak strony zasadna wydaje się konstatacja,
że przyjęte rozwiązania, co do zasady, zmierzają do ograniczenia nadużyć – czyli
sytuacji, gdy umowy terminowe w nieuzasadniony sposób zastępują umowy na czas nieokreślony
z niekorzyścią dla pracowników.
Description:
The author makes an attempt at assessing legal regulations adopted in the Act of 25
June 2015 on Amendments to the Labour Code and to Some Other Statutes. According to
the author, the introduced provisions are not based on coherent general assumptions that
would take due account of functions performed by employment agreements with a fixed
time of duration, in particular by agreements for a definite period of time. On the other
hand, the analysis of the cited provisions seems to corroborate that their adoption is aimed,
at least as a rule, at limiting the abuse of law, i.e. at combating the conclusion of employment
agreements with a fixed time of duration at a disadvantage of employees in situations
where agreements for indefinite time should be entered into.
